I am an intellectual property attorney with over 20 years of experience handling a wide variety of legal matters. I have substantial experience litigating patent, trademark and copyright infringement matters in courts across the country, as well as advising clients across a broad range of businesses and technologies on matters involving the management of their intellectual property rights and assets.

KEY ACCOMPLISHMENTS

 

  • I served as a member of the trial team representing Monsanto Company in a breach of contract and patent infringement litigation brought against Pioneer Hi-Bred International, Inc. (Monsanto Co. v. Pioneer Hi-Bred Int’l, Inc., Case No. 4:97CV01609-ERW).  The trial judge entered an order in Monsanto’s favor, terminating the 1993 Development/Licensing Agreement between Pioneer and Monsanto and awarding Monsanto its attorneys’ fees, litigation expenses and costs.

 

  • I served as second-chair trial attorney in an unfair competition action in the United States District Court for the Eastern District of Missouri on behalf of plaintiff, Home  Builders Association of Greater St. Louis (Home Builders Assoc. of Greater St. Louis v. L&L Exhibition Mgt., Case No. 4:97CV01905-MLM).  Following a week-long bench trial, the Court entered judgment in favor of our client, entered a permanent injunction against the defendant and awarded our client its damages and reasonable attorneys’ fees and costs.

 

  • I served as second-chair trial attorney in a design patent infringement action in the United States District Court for the Eastern District of Missouri on behalf of defendant, True Manufacturing Company, Inc. (Specialty Equipment Cos., Inc. v. True Manufacturing Co., Inc., Case No. 4:97CV01969-CAS).  The jury returned a defense verdict in favor of our client. 

 

  • I served as a member of the litigation team in a patent infringement action on behalf of plaintiff, Monsanto Company (Monsanto Co. v. Scruggs, et al., Case No. 3:00CV161-P-A).  The Court granted summary judgment on behalf of Monsanto on its patent infringement claims and denied defendants’ summary judgment motion on their patent invalidity counterclaims. 

 

  • I served as a member of the trial team in a patent infringement action tried in the United States District Court for the Eastern District of Missouri.  Our client was declaratory judgment action plaintiff, Monsanto Company (Monsanto Co. v. Bayer Bioscience, N.V., Case No. 4:00CV01915-ERW).  At the conclusion of a three-week long trial, the jury returned a verdict in our client’s favor, including a finding that Monsanto did not infringe the patent-in-suit and a finding that the patent-in-suit was invalid.  Following the jury trial, the Court heard evidence on the issue of inequitable conduct and entered an exceptional case finding in our client’s favor, awarding Monsanto over $8.5 million for its reasonable attorneys’ fees and costs.
